On the balance of probabilities and having considered the clinical records, the compulsory treatment order and psychiatric assessments indicating a delusional disorder that impairs insight and judgment specific to this litigation, P cannot understand the nature, purpose, outcomes and risks of the appeal or give sufficient instructions; therefore P is an incapacitated person under r 4.29 and a litigation guardian must be appointed under r 4.30; the Court appointed Ms Kelly Neill and directed immediate case management.
