The Environment Court did not make errors of law: it properly had regard to Schedule 24.8 and the proposed plan, correctly treated the Wakatipu Basin Study as non‑statutory background material, applied the relevant tests under s104, weighed density controls and site‑specific evidence, and made factual findings on landscape character supported by expert evidence and its own site inspection; the appellants failed to demonstrate a legal error materially affecting the result, so the appeal is dismissed.
