Leave to appeal was refused because the statutory issue was confined and transitional, the lower tribunals and courts had reached a consistent view that s141 applied to all members of the new claim, there was no real prospect the Supreme Court would differ, and the delay and cost of further appeal were not justified in the absence of demonstrated public importance or interest of justice.
