The Court held the appeal was a standard matter and directed Court of Appeal costs be calculated at the category two daily recovery rate; High Court costs are to be calculated using rates in force prior to 1 August 2019; District Court costs for claim and counterclaim should lie where they fall because settlement offers did not make the trustees' continuation unreasonable and the first offer was too uncertain; no costs were awarded for the costs dispute and leave was reserved for calculation issues.
