The proceedings were struck out as an abuse of process because they impermissibly sought to relitigate matters already finally determined on appeal, attacked witnesses whose courtroom statements are absolutely privileged, and pleaded claims so unclear and duplicative that it would be manifestly unfair to require respondents to answer them.
