The insurer acted prematurely in determining the appellant had capacity for work because it initiated the work capacity assessment before completing vocational rehabilitation required by the IRP and in circumstances where the work trial remained ongoing and medical advice (Dr Ruttenberg) indicated further multidisciplinary rehabilitation and occupational therapy input were necessary; accordingly the appeal is allowed.
