01

Holding and result

The prosecution failed to prove beyond reasonable doubt that the appellant corruptly received the sum of Shs. 12,000; the evidence did not exclude the reasonable possibility that the money was payment for poles, not a bribe. The conviction was unsafe due to lack of corroboration and insufficient evidence.

Court disposition

Appeal allowed; conviction quashed; sentence set aside.

Orders

  • Appellant to be released forthwith unless otherwise lawfully held.

Questions and positions

Legal issues

Party arguments

Applicant
The appellant, as a CCM employee whose duties did not include plot allocations, had nothing to do with his principal's affairs regarding the alleged transaction. Even if he was a government agent, it was not proved that he corruptly received the money. The complainant was an accomplice and his evidence was uncorroborated, making the conviction unsafe.
Respondent
The conviction was supported as the points raised did not prejudice the conviction. The appellant was found in possession of the money and the trial magistrate was justified in rejecting the defence.

Court’s reasoning

  1. 01

Local Government (District Authorities) Act No. 7 of 1982, section 142; Prevention of Corruption Act No. 16 of 1971, section 3

A person performing public duties and responsibilities, whether paid or not, and recognized as holding the position of a public servant, must be regarded as such and cannot deny being a public servant merely because of the source of remuneration.

  2. 02

    R v. Kumwenda s/o Mwalwanda (1969) HCD n. 230

Evidence of an accomplice requires corroboration for a safe conviction.

  3. 03

    General criminal law principle

The prosecution must prove its case beyond reasonable doubt.

06

Ratio, limits and disposition

Ratio decidendi

The prosecution failed to prove beyond reasonable doubt that the appellant corruptly received the sum of Shs. 12,000; the evidence did not exclude the reasonable possibility that the money was payment for poles, not a bribe. The conviction was unsafe due to lack of corroboration and insufficient evidence.

Obiter and limits

  • Officials who accept to work under responsibilities or caps of public service should not be allowed to deny accountability when required by law, regardless of whether they are paid by government or party.

Court disposition

Appeal allowed; conviction quashed; sentence set aside.

  • Appellant to be released forthwith unless otherwise lawfully held.
