LAND APPEAL NO
The Tribunal erred in treating a residential licence as conclusive proof of ownership and in granting relief to the Fifth Respondent absent a counterclaim. The First Respondent was not the sole owner and could not mortgage the property. The Appellants and First Respondent jointly hold better title. The Fifth Respondent was not a bonafide purchaser due to constructive notice of dispute.
