The originating summonses in HCMP 1085/2024, HCMP 1098/2024, HCMP 1254/2024 and HCMP 1536/2024 were struck out because they fail to disclose any reasonable cause of action, are malicious/vexatious and an abuse of court process, and insofar as they purport to claim against judicial officers the claims are barred by Basic Law Article 85 judicial immunity.

The amended writ and amended statement of claim were struck out because the pleaded allegations failed to disclose any reasonable cause of action, were frivolous/vexatious and an abuse of court process; the claim was time‑barred with no admissible evidence to invoke exceptions under the Limitation Ordinance; the US$20,000,000 claim lacked any pleaded basis for calculation; accordingly the claim had no real prospect of success and was dismissed.

Default judgment summons was revoked because the writ was not proved served on the defendants and the summons was prematurely issued; the statement of claim was struck out because, on assumed facts, it disclosed no reasonable cause of action, was frivolous, scandalous and an abuse of court process as the matters complained of concerned association affairs not personal negligence, and the action was dismissed; costs orders were moderated because of the plaintiff's mental health.

The purported joinder of Mr Lai was made without the court's leave; accordingly the Registrar of Civil Appeals was entitled to expunge the notice of appeal and related documents and the applicant's appeal against the Expunction Order and the Notice of Motion is dismissed.

The pleadings failed to disclose any reasonable cause of action because the plaintiff did not plead facts establishing any contractual or tortious duty by the first defendant; the claim was therefore frivolous, vexatious and an abuse of process. The strike-out order was upheld and the appeal dismissed with costs.

The counterclaim, while not frivolous on its merits because the termination letter was ambiguous and no clear consideration was shown, must be struck out for want of jurisdiction and as an abuse of process because monetary claims for breach of employment contracts fall within the Labour Tribunal's exclusive jurisdiction and the counterclaim in the CFI was not the subject of a valid transfer under s.10 of the Labour Tribunal Ordinance.

經修改的申索陳述書未能披露針對被告人之合理人身傷亡訴訟因由，並且屬瑣屑無聊或無理纏擾，構成對法庭程序的濫用；教育局在履行政職能時一般不負對個別投訴人之民事謹慎責任；申索亦未遵從O.18 r.12及相關實務指示之形式要求；基於此，維持聆案官決定，剔除申索並撤銷訴訟，相關披露申請亦應撤銷。

The claimant's statement of claim failed to disclose a reasonable cause of action and omitted mandatory particulars and statutory procedural requirements for a personal injury claim (absence of medical report and statement of special damages); the pleaded claims were frivolous or an abuse of process and were, in any event, time-barred; the defects were incurable by amendment, therefore the strike-out of the claim and dismissal of the proceedings were justified and the appeal must be dismissed.

原告的申索陳述書未能顯示任何使被告個人負有交付租金或其他個人法律責任的關鍵事實；相關指稱實質上涉及被告之僱主ISS或機構行為而非被告個人，且有部分指稱無實際基礎屬瑣屑無聊，故在明顯情況下剔除申索並撤銷訴訟為適當；上訴雖逾期但基於短期逾期、未構成重大不公及無律師代表等理由准予延長。

The defect was incurable and the appropriate remedy was to strike out the statement of claim, dismiss the action and award costs to the defendant (assessed at HK$58,000 on an indemnity basis).
