The application for leave to apply for judicial review was dismissed because CAPO's subsequent reclassification of the complaint to 'substantiated' meant the applicant had effectively obtained the practical relief sought, rendering the proceedings academic with no sufficient public interest to continue; accordingly leave was refused and no order as to costs was made.

The appeal was rendered academic by the defendants' decision to withdraw the third party proceedings; therefore the defendants, as the withdrawing/conceding party, must bear SVK's costs of the appeal and specified interlocutory proceedings, to be taxed on a party-and-party basis if not agreed; indemnity costs were not awarded.

HCMP 3360 dismissed because the relief sought under s111(2) was academic given Section 351A removed any risk of prosecution for the relevant period; HCMP 3361 granted only for years where prosecution remained possible (years ending 31 March 2010 to 31 March 2012) because failures were inadvertent and caused no prejudice; HCMP 3362 granted in the terms of the originating summons.

The Court of Appeal allowed the appeal, set aside Sears J's order and remitted the matter to the Court of First Instance for determination of costs because Sears J proceeded on a material and substantial factual error (incorrectly treating the costs as trivial), rendering his refusal to determine the costs and his dismissal of the originating summons an unsustainable exercise of discretion.
