On the facts the court accepted that Lee executed all trading after 3 November 1997 without the Defendant's authority, Lee admitted misuse and made payments that reduced the margin account; therefore the Plaintiff could not recover the cash-account deficit but was entitled to recover a net sum of HKD 101,637.70 plus interest for the margin account; costs were ordered by way of an order nisi that the Plaintiff bear the Defendant's costs (taxed on High Court scale) unless varied within 21 days.
