The petition was dismissed because the petitioner repeatedly sought adjournments over a six‑month period while documents were ready, demonstrated no intention to be adjudicated bankrupt, and the court must not waste judicial time on indefinite delay; therefore dismissal was the appropriate disposal and costs were awarded to the Official Receiver.

The court refused the application to intervene and for adjournment and ordered sale because the intended intervener produced no credible evidence of a proprietary interest, her material was belated and inexcusable, and her conduct appeared designed to delay enforcement; accordingly the sale order and consequential costs and payment directions were justified.

The appeal was allowed and the original sentence reduced because the magistrate's starting point of two years was appropriate but a greater discount than applied was warranted given the appellant's admitted and valuable assistance to the prosecution, including in multiple matters, and delays beyond his control; accordingly sentence reduced to 13 months imprisonment.
