The Court held the undercover agent's evidence was admissible and the summing-up was fair; although the Applicant participated in the conspiracy his role was materially lesser and there was insufficient evidence to conclude he was aware the quantity was as high as 3 kilograms, therefore the appropriate sentencing band was reduced to the 200–400 grammes band under Lau Tak Ming and the sentence on count 1 was reduced from 20 years to 12 years under its appellate power pursuant to CPO s83I(3).
