For trafficking involving quantities of heroin where the narcotic content is under 1,000 grams the appropriate starting point in this case is 22 years imprisonment; applying a 10‑year reduction for early plea and substantial cooperation yields a sentence of 12 years, and the appeal is allowed to that extent.

Given the enormous quantity involved (70 kg conspiracy), the sentencing starting point and the 20% discount applied were not erroneous; sentencing guidelines then applicable supported sentences in the region of 20 years for quantities above 20 kg, so the appeals against sentence are refused.
