The 1972 memorials taken together with the signed Division of Property and Division Plan formed a series of transactions showing the agreed division of the whole land as LTW 3/5 and LLW 2/5; memorial 170605 was certified under s19 Cap.97 and is a correct memorial; the defendants failed to justify the alternative 9/20 figure and their expert evidence on legal effect was inadmissible, therefore the court declared the 3/5:2/5 shares and ordered partition and consequential relief.
