The court exercised its discretion to order partition in accordance with the SRP and LBP because the proposed partition was practicable and consistent with long‑standing physical division (two self-contained houses), the area difference was minimal, survey evidence established no encroachment and the District Lands Office raised no adverse comment, and there was no opposition from the estate representative; accordingly partition was ordered and costs reserved.
