The Court held that mandatory conditions imposed under the former Miscellaneous Licences regulations were validly attached to existing licences and continued in force by s.23(1) of the Amusement Game Centres Ordinance (Cap.435); accordingly the Commissioner was entitled to impose additional conditions under s.23(2) and the Temporary Magistrate erred in holding those conditions ultra vires.
