The court held that the mandatory conditions originally imposed by Reg.152 were validly attached to the licence issued under the Miscellaneous Licences Ordinance, those conditions continued to bind the licence after repeal under s.23(1) of the Amusement Game Centres Ordinance, and accordingly the Commissioner had power under s.23(2) on 1 December 1993 to impose further conditions; the Temporary Magistrate erred in holding there were no valid existing conditions.
