The court granted leave to adduce the Passbook extract as fresh evidence because it was newly disclosed by the defendants, was prima facie credible, and related directly to the source of the Fixed Deposit central to the dispute; therefore it satisfied the Ladd v Marshall criteria including that it might have an important influence on the appeal and on any fresh exercise of discretion regarding the Ancillary Disclosure Order.
