Although costs normally follow the event, the court exercised its discretion to recognize that the Communications Authority was justified in contesting and appealing novel and significant issues of regulatory law in the public interest and that it had partial success on several issues; accordingly the Authority was required to pay 75% (not 100% or 50%) of the Applicants' costs of the appeals and the proceedings below, to be taxed if not agreed, with a certificate for two counsel.
