Although costs normally follow the event, the Court exercised its discretion recognising that the Communications Authority raised and succeeded on some novel and public‑interest legal issues; accordingly the Authority was ordered to pay 75% of the Applicants' costs of the appeals and below, taxed if not agreed, with a certificate for two counsel.
