After rehearing the evidence, the court accepted the trial judge's credibility and identification findings and the CCTV interpretation; the footage and witness evidence show the appellant intentionally brushed X's left buttock with the back of his hand and the touching was not accidental, proving the offence beyond reasonable doubt, thus the appeal fails.

On rehearing the court found the driving‑recorder video and the expert evidence created a real and plausible basis that the appellant suffered a sudden incapacitating medical event (LVNC) at the material moment; the trial judge lacked sufficient basis to wholly reject the appellant and expert evidence, and therefore the prosecution did not prove the dangerous driving offence beyond reasonable doubt; conviction quashed.

On rehearing the High Court found the magistrate's immediate custodial sentence was manifestly excessive given the small scale (12 beers), limited number of customers and premises size, the appellant's admission, lack of prior convictions and remorse; having regard to precedent the appropriate sentence was a fine of HK$10,000, and the appeal was allowed with the original custodial sentence quashed and replaced by that fine.

Trial judge accepted the 12‑year‑old complainant's credible and consistent evidence that the appellant's whole palm contacted her buttock for 1–2 seconds; appellant's inconsistent, implausible account and demonstrable differences with his pre‑trial statements undermined any innocent explanation. The touching could not reasonably be accidental; prosecution proved indecent assault beyond reasonable doubt; 28 days' imprisonment was an appropriate deterrent sentence and was upheld.

The magistrate's finding that the appellant failed to prove non‑receipt of the fixed penalty notice was not due to his own negligence was reasonable and justified; accordingly the appellant's review and appeal must be dismissed and the original order affirmed.
