On rehearing the appellate judge accepted the magistrate's findings that PW1's identification was credible and reliable, found the circumstantial matrix supported an irresistible inference that the appellant was working while subject to a deportation order, held that absence of CCTV or forensic evidence did not undermine reliable identification, and concluded guilt proved beyond reasonable doubt; the sentence of 22 months and 15 days was appropriate and not excessive given prior similar conviction and conviction after trial.

On rehearing the court was not satisfied beyond reasonable doubt that the biting dog was the appellant's dog; material doubts arose from a credible alternative identification (DW1’s evidence that the dog was a black mongrel) and from PW2’s demonstrable misidentification of the person associated with the dog, thereby rendering the conviction unsafe and requiring it to be quashed.

After rehearing the evidence, the court accepted the trial judge's credibility and identification findings and the CCTV interpretation; the footage and witness evidence show the appellant intentionally brushed X's left buttock with the back of his hand and the touching was not accidental, proving the offence beyond reasonable doubt, thus the appeal fails.

Trial judge properly and repeatedly viewed CCTV footage and compared it with contemporaneous hospital photographs; cumulative features — identical football shirt with identifiable marks, short hair and hairline, matching short trousers with Adidas marking, observed change of footwear, repeated appearances on clear channel footage, and head injury consistent with medical report — supported reliable identification. The judge had taken Turnbull cautions into account. The totality of evidence proved the appellant's participation in the affray beyond reasonable doubt; conviction stands.

The conviction was unsafe because it rested solely on the evidence of PW1 whose credibility and reliability were seriously impugned by adverse findings in related proceedings and by inconsistencies in his records and testimony; the trial judge failed to give proper weight to those considerations and improperly disbelieved the defence counsel's explanation, producing unfairness. In those circumstances and having regard to the standard of proof, the appeal is allowed and the conviction and sentence are quashed.
