The Court allowed the appeal, set aside the orders of the Deputy High Court Judge dated 3 April 2023, and remitted the application for leave to apply for judicial review by the applicant and her son to the Judge for reconsideration.

The Master did not err in ordering joinder based on the affidavit evidence before him and had no duty to scrutinize draft pleadings; there was no basis to vary the Master’s costs orders because Mrs Balani actively opposed the applications and lost, and the court’s reduction of appeal costs to 50% was a measured response to deficiencies in particulars rather than grounds to alter other costs orders.

Given the solicitors' repeated advice to the client and that they acted on his instructions, there was no evidence of professional misconduct sufficient to satisfy the stringent test in RHC Order 62 Rule 8; accordingly solicitors were not ordered to pay costs personally and no order was made on costs of the show cause proceedings.

The application to vacate the appeal hearing dates was dismissed because the plaintiff declined available earlier restoration dates, offered unreasonable grounds amounting to delay, the defendants reasonably refused to jeopardise fixed appeal dates, and an order nisi on costs is not a proper subject of appeal until made absolute.
