The appeal is dismissed because the hearing judge's order was correct and not open to appeal: the appellant improperly attempted to join a third respondent without application, introduced new and legally inappropriate causes of action that did not disclose reasonable causes and amounted to an abuse of process, failed to satisfy the Ladd v Marshall criteria for fresh evidence, and there was no basis to set aside the interlocutory costs order; consequentially the appellant must pay the respondents' costs of the appeal.
