The Court awarded the 4th Applicant his costs of the trial insofar as they related to Charges 4 and 5 because his convictions on those charges were set aside on appeal and there was no basis to find he had brought suspicion on himself; however, the Court refused to order costs against the Respondent for its unsuccessful s32(2) HKCFAO application because it was not satisfied that the application was without merit.
