Given the liquidators' established and reasonable concerns about relatedness of proposed committee members, the dubious basis of many proofs of debt, ongoing investigations into misfeasance and asset transfers, and the likelihood that a committee dominated by connected parties would hamper investigations and increase costs, the court exercised its discretion to vary the earlier order and not to appoint a committee of inspection for the time being, with liberty to liquidators to apply for directions under s200(3).
