On the balance of probabilities the Approval was served before commencement of proceedings, the applicant knowingly misrepresented receipt in correspondence and changed his case, and having had actual notice the applicant should not have instituted/continued the proceedings; accordingly the respondent is entitled to costs including counsel's certificate to be taxed if not agreed on District Court scale.
