The court held the plaintiff demonstrated a good arguable case under the relevant Order 11 r 1 gateways for the Agreement, the two Contracts and the oral anchor removal, that there were serious issues to be tried, and that Hong Kong is the appropriate forum; further, the arbitration clauses in the two Contracts were void or incapable of performance under PRC law and therefore did not bar Hong Kong proceedings, so leave to serve out of jurisdiction and a concurrent writ were granted.
