    Having assessed the parties’ assets, incomes, housing benefit to respondent and the child’s needs, the court concluded respondent had capacity to pay more than HKD6,000 and ordered child maintenance of HKD11,000 per month until the child is 18 or completes full‑time university; the decision was based on joint responsibility to meet the child’s needs, the s7 factors and practical evaluation of disclosed financial information.

    On a broad‑brush assessment the children’s reasonable needs were assessed at HK$28,454 per month and the respondent’s assessed monthly income at HK$38,000 with allowed expenses HK$23,560, rendering him able to pay interim maintenance; accordingly the court ordered interim maintenance of HK$10,000 per month (HK$5,000 each) from 1 January 2021, payable into the petitioner’s designated account, subject to respondent’s undertaking to pay the daughter’s insurance premium.

    Because the petitioner failed to make full disclosure and had recently sold a flat for $120,000 with no adequate explanation for the application of the proceeds, the court drew an adverse inference as to his means and concluded he had capacity to pay reasonable maintenance; the petitioner was ordered to pay the respondent HKD 400 per month, commencing 31 July 1978, with costs to the respondent to be taxed under the Legal Aid Regulations.
