On the balance of probabilities the defendant contracted with the plaintiff to take over the hire of the 38 sets of platforms from 28 June 2001; documentary evidence (approved quotation, signed correspondence by the defendant's project manager and collection notes) established acceptance and assumption of liability, the defendant failed to prove it acted as a paying agent for Silver Link or to call supporting witnesses, and the plaintiff had provided particulars of loss and damage; accordingly judgment was entered for the plaintiff with interest and costs.
