On the available evidence, including Google AdWords monthly search data, the continuing online presence of the defamatory material despite complaints, and the common defamatory phrase used across postings, the court was entitled to infer a real and substantial tort committed in Hong Kong; therefore leave to serve out should not be set aside and the defendant's appeals were dismissed.
