The Court held that the plaintiffs established a sufficient platform of facts and that an inference of substantial publication in Hong Kong could properly be drawn (supported by Google AdWords monthly search data of 320 and the continuing presence of the material despite takedown requests); corporate plaintiffs need not plead special damage at this interlocutory stage; therefore a real and substantial tort was arguably committed in Hong Kong and the Judge correctly refused to set aside leave to serve out — appeal dismissed.
