The Court held that the appellant failed to show entitlement to an extension of time, failed to satisfy conditions for admitting fresh evidence (most materials were available earlier and not material), the statutory demand and petition complied with the Bankruptcy Ordinance and s.6/6A showed apparent inability to pay, the alleged counterclaim was unsubstantiated, and constitutional challenges were misconceived or irrelevant; accordingly the appeal and all interlocutory applications were dismissed and no stay granted.
