The Court dismissed the application for leave to appeal because the applicant failed to identify any question of great general or public importance as required by s22(1)(b) HKCFAO and the grounds advanced were not viable, such that the statutory requirements for granting leave were not met.

The Court dismissed the notice of motion and refused leave to appeal because the applicant failed to identify any question of great general or public importance under s22(1)(b) HKCFAO and no other basis justified granting leave to the Court of Final Appeal.

The applications for leave were refused because the amounts assessed by the IDT under s23(1)(b) SIDO are not liquidated proprietary claims and therefore do not engage s22(1)(a) HKCFAO; moreover the grounds advanced did not meet the high threshold for leave under s22(1)(b), involved issues bound by Court of Final Appeal precedent or were otherwise hopeless, so leave was properly refused.
