The court was satisfied that the statutory condition in Section 45(e) of the Trustee Ordinance was met (no personal representative of the deceased trustee and uncertainty as to representation) and that the applicant is beneficially entitled, and therefore a vesting order should be made in favour of the applicant.

The appeal was dismissed because the 2nd Respondent failed to establish beneficial entitlement or any special circumstances justifying release of restrained funds, failed to make full and frank disclosure of worldwide assets as found by the Deputy Judge, and was absent from the hearing such that dismissal was appropriate.
