The conviction was unsafe and must be quashed because the sole critical witness was shown to be error-prone and adamant about facts contradicted by CCTV, there were unresolved concerns about identification and date of the offence, and reliance on that unreliable single witness created a lurking doubt as to guilt.

The trial judge's acceptance of the complainant's identification and credibility is supported by CCTV corroboration and the facts (appellant seen placing the bottle in her bag then returning it), establishing appropriation with dishonest intent; there was no error in the judge's findings, and the court could not override the Legal Aid Department's final decision under Cap.221D r12(2).

The conviction was upheld because the trial judge correctly applied the Turnbull criteria, accepted the credible testimony of the eyewitness, and had objective corroboration from CCTV showing sufficient opportunity, lighting and conduct to identify the appellant; those factual findings were not irrational or unsupported and therefore the appeal was dismissed.

Leave to appeal was refused because the trial judge correctly applied Turnbull: although identification had weaknesses, it was supported by other evidence (applicant's admissions, CCTV showing him with a weapon, and his failure to explain those facts), making the conviction safe; the sentence of 30 months, while lenient, was not so excessive as to warrant interference given the aggravating features and need for deterrence.

The trial judge acted within proper discretion in accepting PW1's direct evidence as credible and in finding corroboration in the CCTV footage and medical/eyewitness signs of injury; the inconsistencies in peripheral matters (pen handling, photos) did not undermine the core evidence and there was no basis for appellate interference with conviction or with the six‑month sentence.
