The appellate judge upheld the conviction because the magistrate applied the correct standard of proof and preferred the credible, consistent evidence of the two police officers over the appellant's account; however the six month sentence was reduced because it was manifestly excessive for the lesser offence of possession and was substituted with 21 days imprisonment.

The Chan Chi-man tariff applies to the total mass of cannabis resin seized; THC concentration is a mitigating or aggravating adjustment only.
