There was no triable issue as to title to sue because both shipper and consignee sued together; therefore discovery as to title was unnecessary. The Registrar's order was varied to require a limited, structured list of documents (a general description of documents already produced and specified additional items), to be filed within 14 days. The reference was transferred to the judge for case management and the trial dates were vacated and refixed. Costs of the appeal were apportioned with the plaintiffs receiving half of the appeal costs.
