The court admitted both appellants to bail pending arraignment on the same terms as their prior bail; the 1st appellant's application to reduce cash bail to $50,000 was refused because the asserted hardship was unsupported by evidence.

The financial penalty was quashed because the magistrate failed to explain the imposition of the fine, failed to ascertain consent to take the fine directly from cash bail and failed to inquire into the appellant's ability to pay, contrary to established authorities; those procedural and substantive deficiencies undermine the validity of the fines.

Forfeiture of cash bail is a civil matter and should be appealed in the civil jurisdiction, but where a surety has made serious attempts to secure attendance and the trial judge gave no reasons for full forfeiture, the appellate court may remit part of the forfeited sum under s.13AA; accordingly the Court allowed a 50% remission.
