The Court held that the appellants are entitled to taxed costs of the original trial and of their appeals and related applications because the successful ground (latent duplicity) was substantive and not a mere technicality, the unsuccessful grounds before the Court of Appeal were not wholly unmeritorious, there were insufficient positive reasons to deprive costs, and the Magistrates' Court costs should form part of retrial costs; a certificate for three counsel was justified given complexity and involvement of London silks.
