Defendant failed to demonstrate any real or bona fide defence to the claim: his affidavit was sparse and internally inconsistent, the alleged collateral agreement was not evidenced in the contemporaneous memorandum signed by both parties and was inconsistent with subsequent payment behaviour; therefore summary judgment was appropriate and entered for the plaintiff for principal and interest.
