- Citation
- HKSAR v. POON SIU WAI MARTIN
- Court
- Court of First Instance
- Case number
- HCMA1012/2001
The magistrate's adverse credibility findings were lawful and supported by inherent improbability and contradictions in the appellant's account as well as his demeanour; the wife's reluctance to report to police was a legitimate matter relevant to her reliability because she was competent to be called under s.57 Cap.221, and the magistrate did not place undue or sole reliance on demeanour; accordingly there was no legal error and the conviction and sentence were upheld.
