The wife's application for third‑party discovery was dismissed because the evidence of necessity relied upon — the Expert's notes — was inadmissible (unsigned and lacking the formal declarations required by O.38 r.37C), and absent admissible expert evidence the wife failed to satisfy the necessity limb for non‑party disclosure; accordingly the court exercised its discretion to refuse the requested discovery and ordered costs for the Companies on an indemnity basis.
