The Court held the Magistrate did not misapply her sentencing discretion: a fine of HK$15,000 was within an appropriate range given the facts and mitigation, and courts must not adjust an otherwise appropriate sentence to enable a spent conviction under the Rehabilitation of Offenders Ordinance; therefore there was no basis to interfere and the appeal was dismissed.

Convictions and sentences were upheld because the evidence as recorded and submissions satisfied the court; however the magistrate lacked jurisdiction to order confiscation of the 120 magazines that were not produced in court, so that part of the confiscation order must be set aside while the 19 produced exhibits may be confiscated.

The conviction was quashed because the factual findings did not establish the element of obstruction under section 4A; consequently the conviction was unsafe despite the appellant's guilty plea and the concomitant penalties (fine and confiscation) were ordered returned.
