Because the plaintiffs' formulated quantum, supported by recently disclosed documents, exceeded the District Court's $1,000,000 jurisdictional limit and there was no abuse or mala fides and nothing conclusively contradicting that quantum at interlocutory stage, the Court was obliged under s41(1) to transfer the Main Actions to the Court of First Instance; the Harbour Base Actions were also transferred to be heard together and the District Court trial dates were vacated, with costs ordered as costs in the cause with a certificate for one counsel.
