The Notice's definition of 'unit' is determined by reference to premises described by reference to a specified number of undivided shares in instruments registered in the Land Registry; physical subdivision works and breaches of private instruments or building permits are not prerequisites to recognition of a unit under the Notice. Consequently, the two units registered on 31 March 2010 are separate units for the Notice and the lowered 80% threshold does not apply; the appeals are allowed and the compulsory sale application in LDCS No.11000/2011 is struck out.
