The court refused leave to appeal because the questions raised were not shown to be of great general or public importance and were not reasonably arguable: the Notice expressly defines 'unit' by reference to undivided shares in the lot (s.2) so the ordinary meaning of 'unit' or 'premises' does not assist, and any breach of DMC or other instrument does not affect the validity of the allocation of undivided shares by registration; consequently the Notices of Motion were dismissed.
