On the facts—appearance with the prostitute immediately after a request, the appellant's recommendation of the girl, and the discovery of $300 of the $400 fee on the appellant—there was sufficient evidence to raise the presumption in s.137(2) that the appellant was exercising control, direction or influence and knowingly living on the earnings of prostitution; the appellate court may apply the presumption even though the magistrate did not invoke it; appeal dismissed.
