The court dismissed the Interveners' summons and the Respondent's summons as out of time, awarded costs to the Petitioner, ordered summary assessment with certificate for one counsel and disallowed additional counsel fees claimed by the Petitioner; fixed costs at HK$65,000 against the Interveners jointly and severally and HK$21,000 against the Respondent.

The judge accepted the plaintiff's and his wife's credible oral evidence and documentary proof (the cheque), found the defendant liable to repay HK$386,244.46, awarded interest for loss and awarded full costs to the plaintiff including reserved costs and fees for the briefed counsel; the trial could lawfully proceed under Order 35 in the defendant's absence.

The court made a bankruptcy order because the debt was established by a judgment and Interim Certificate of Costs amounting to HK$526,874.15, substituted service had been properly effected, and the debtor failed to make payment despite an earlier adjournment and representation of an offered payment that was not fulfilled, thereby satisfying s6(4) grounds for a petition presented without a statutory demand.

The appeal was allowed because there are substantial and unresolved factual issues that require trial and the 2nd defendant's defence is not so clearly unfounded as to justify conditional summary disposal; accordingly the 2nd defendant was granted unconditional leave to defend, a certificate for counsel should have been granted, costs orders were varied to costs in the cause, and the judgment entered against the 2nd defendant was set aside.
